CDL DUI Lawyer in Orlando

Arrested for DUI while Driving a Commercial Vehicle in Florida?

If you are a driver or operator of a commercial vehicle in Florida, you are subject to stricter DUI laws. As a result, you could face harsher penalties if you are convicted of DUI with a CDL. These penalties may include jail time and fines.

Additionally, you may be subject to suspension of your commercial driver's license, which puts your ability to make a living and support your family in jeopardy.

If you have been arrested for DUI while driving a commercial vehicle, it is important to hire an Orlando CDL DUI lawyer as soon as possible. Our team at Ali & Blankner is here to help you navigate the legal system and protect your rights.

The genuine care and concern Mr. Ali showed us during a difficult time were very much appreciated. It has been a long journey, however, Mr. Ali and the team at Ali & Blankner have been there with us each step along the way.

Florida CDL DUI Laws

What Is the CDL DUI Limit?

The BAC limit for commercial drivers in Florida is .04 percent. This is an important distinction from the BAC limit for non-commercial drivers, which is .08 percent.

Penalties for a First Offense CDL DUI

In the state of Florida, a CDL holder faces harsh criminal penalties for a first-time DUI conviction. The penalties include a fine of up to $1,000 and up to six months in jail.

Additionally, a CDL holder may lose their job due to the conviction, leading to financial hardships. If you have been arrested for a CDL DUI, protect your future by retaining the help of an Orlando commercial driver DUI attorney from Ali & Blankner.

Can You Lose Your CDL If You Get a DUI?

If a commercial driver operates a commercial motor vehicle (CMV) with a BAC of .04 percent in Florida – or a BAC of .08 percent while driving a personal vehicle – their commercial driver's license will be disqualified for one year.

Refusal to submit a chemical test (i.e., a breath, blood, or urine test) after a DUI arrest in Florida will also result in a one-year CDL disqualification. A second DUI conviction or chemical test refusal can lead to permanent CDL disqualification.

And, keep in mind, commercial drivers who are subject to CDL disqualification are prohibited from obtaining a hardship license to operate a CMV.

CDL DUI in a Personal Vehicle

Drivers holding a commercial driver’s license are held to stricter standards than non-commercial drivers when it comes to driving under the influence. In the state of Florida, if a CDL holder is arrested for DUI while off-duty and in their personal vehicle, they will be subject to the same criminal penalties and consequences as non-commercial drivers.

Additionally, commercial drivers who are convicted of DUI while driving a personal or non-commercial vehicle will still face a one-year disqualification of their CDL.

If you are a CDL holder who has been arrested for DUI while driving a personal vehicle, it's important to understand the gravity of the consequences you currently face. Get in touch with our CDL DUI lawyers in Orlando for an aggressive defense.
