What Is the Blood Alcohol Concentration (BAC) Limit for Commercial Drivers in Florida?
The BAC limit for commercial drivers in Florida is .04 percent. This is an important distinction from the BAC limit for non-commercial drivers, which is .08 percent.
If a commercial driver operates a commercial motor vehicle (CMV) with a BAC of .04 percent--or a BAC of .08 percent while driving a non-commercial vehicle--their commercial driver's license (CDL) will be disqualified for one year. Refusal to submit a post-arrest chemical test will also result in a one-year CDL disqualification.
A second DUI conviction or chemical test refusal can lead to permanent CDL disqualification.
Keep in mind, commercial drivers who are subject to CDL disqualification are prohibited from obtaining a hardship license to operate a CMV.
Lastly, a conviction can also result in criminal penalties, from a jail sentence or probation to fines and a criminal record.
