Orlando Aggravated Assault Lawyer
Former Prosecutors Examine Every Element of a Felony Assault Charge
An aggravated assault charge turns on the reported threat, the accused person’s intent, and whether a deadly weapon or intended felony was involved. At Ali & Blankner, our former prosecutors examine those elements and apply the defense theories supported by the circumstances.
Aggravated assault is a felony, even when no physical contact occurred. We explain the charge, the potential penalties, and how the prosecution may try to prove its case.

What Florida Must Prove in an Aggravated Assault Case
Under Florida Statute § 784.021, aggravated assault is an assault committed with a deadly weapon without intent to kill or with intent to commit a felony. A deadly weapon allegation and an alleged intent to commit another felony are separate grounds for bringing this charge.
The underlying assault elements come from Florida Statute § 784.011. The prosecution must prove an intentional, unlawful threat by word or act, an apparent ability to carry it out, and an act creating a well-founded fear that violence was imminent. Because the charge focuses on a threat and resulting fear, physical contact isn’t required.
Related Florida Assault Charges & Potential Penalties
Simple assault generally doesn’t include the weapon or intended-felony element required for aggravated assault. Aggravated battery is a separate offense based on battery conduct rather than only a threat that causes fear of imminent violence. The evidence and required elements differ among these charges.
Florida classifies aggravated assault as a third-degree felony carrying up to five years in prison and a $5,000 fine. The 10-20-Life mandatory minimum firearm tiers don’t apply to standalone aggravated assault offenses committed on or after July 1, 2016. A firearm allegation can still affect a case through other charges, enhancements, or legal theories, so its significance depends on the allegations filed.
