In general, possession of PCP is prosecuted at the state level. Federal prosecution may be called for in cases that involve manufacturing, distribution, or trafficking of the drug. Federal penalties include:
- First offense: Up to 40 years in prison and a maximum fine of $2 million. Twenty years in prison if death or serious injury is caused as a result of the crime.
- Second offense: Possible life imprisonment and a maximum fine of $4 million. Mandatory life imprisonment if death or serious injury is caused as a result of the crime.
Penalties for Trafficking More than One Kilogram of PCP
- First offense: Possible life imprisonment and a maximum fine of $4 million. Mandatory life imprisonment in the event of death or serious injury.
- Second offense: Possible life imprisonment and up to $8 million in fines. Mandatory life imprisonment for instances of death or serious injury.
